This half day session is intended as a reminder/update for senior leaders with a particular focus on the types of case they are likely to encounter as decision makers on employee relation issues, disciplinary, grievances and appeals. It is worth remembering though, that senior leaders are also invariably line managers and so need to be refreshed on the basics from time to time.

In this session the update will focus on new and interesting tribunal judgements that may impact the Guernsey Tribunal and other developments in employment law.

We plan to cover:

1. The respective roles in employment law of senior leaders, HR (whether in-house or outsourced) and line managers

An update on Discrimination law and cases with particular attention to:

  • Disability
  • Carer status (with particular reference to working from home)
  • Gender
  • Religion and Belief

2. Essentials of Capability and Conduct with a focus on

  • Handling employee relation issues
  • Testing against policy and procedure
  • Whether the evidence and facts stack up
  • Whether sanctions are reasonable
  • An update on latest cases and where those indicate employers acted unlawfully/unreasonably

3. Essentials of handling Grievances

  • A reminder of the essentials of dispute resolution in management
  • When to intervene informally (and, more importantly, when not)
  • Intelligent use of mediation
  • Grievance decisions, with a particular focus on handling appeals
  • Complex case study
